By accessing or using PentaSwap Labs' website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Service Description

PentaSwap provides enterprise-grade DeFi infrastructure solutions including:

• Cross-chain optimization and routing algorithms
• MEV protection and private transaction pools
• Analytics and market intelligence tools
• Custom enterprise solutions and integrations

All services are currently in private beta and available only to qualified institutional clients.

3. Eligibility and Access

3.1 Qualification Requirements

Access to our services is limited to:

• Institutional clients with demonstrated DeFi experience
• Organizations meeting minimum transaction volume requirements
• Entities that pass our compliance and security review
• Clients who execute appropriate legal agreements

3.2 Private Beta Status

Our services are currently in private beta. We reserve the right to:

• Limit access to qualified participants only
• Modify or discontinue services with notice
• Implement usage limits and restrictions
• Require additional documentation or agreements

4. User Responsibilities

As a user of our services, you agree to:

• Provide accurate and complete information
• Maintain the confidentiality of access credentials
• Use services only for lawful business purposes
• Comply with all applicable laws and regulations
• Not attempt to reverse engineer or compromise our systems

5. Intellectual Property

All content, technology, and intellectual property related to PentaSwap services remain our exclusive property. You may not:

• Copy, modify, or distribute our proprietary technology
• Use our trademarks or branding without permission
• Attempt to extract or reverse engineer our algorithms
• Share confidential information with unauthorized parties

6. Service Availability

While we strive for high availability, we do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with advance notice
• Temporarily suspend services for security reasons
• Implement emergency updates or patches
• Modify service features or capabilities

7. Limitation of Liability

To the maximum extent permitted by law:

• Our services are provided "as is" without warranties
• We are not liable for indirect or consequential damages
• Our total liability is limited to fees paid in the preceding 12 months
• You assume all risks associated with DeFi activities

8. Risk Disclosure

DeFi activities involve significant risks including:

• Smart contract vulnerabilities and exploits
• Market volatility and liquidity risks
• Regulatory changes and compliance requirements
• Technical failures and system downtime
• Loss of funds due to various factors

9. Compliance and Regulations

You are responsible for ensuring compliance with all applicable laws and regulations in your jurisdiction. We may require additional documentation or terminate services if compliance cannot be verified.

10. Confidentiality

Both parties agree to maintain confidentiality of:

• Proprietary technology and algorithms
• Business strategies and client information
• Performance metrics and analytics data
• Any non-public information shared during the relationship

11. Termination

Either party may terminate the relationship with appropriate notice. Upon termination:

• Access to services will be immediately revoked
• Confidentiality obligations remain in effect
• Outstanding obligations must be fulfilled
• Data may be retained according to our retention policy

12. Governing Law

These terms are governed by the laws of the jurisdiction where PentaSwap Labs is incorporated. Any disputes will be resolved through binding arbitration.

13. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated with reasonable advance notice. Continued use of services constitutes acceptance of updated terms.
